The ERA was ratified as the 28th Amendment to the U.S. Constitution on January 27, 2020, when Virginia became the 38th and final state needed for ratification. President Biden also declared this on January 17, 2025. Gender equality has been enshrined in our nation’s foundational document with the ERA. The American Bar Association also recognizes the ERA as the 28th Amendment to the U.S Constitution and Constitutional Scholars also concur that our Constitution now demands that “equality of rights under the law cannot be denied or abridged by the United States or any state on account of sex.”
Anti-equality actors in government choose to ignore it—and the 78% of people in the U.S who support it. Their inaction fuels the ongoing attacks on our rights and keeps the weight of inequality in place.
Despite misinformation and attempts to discredit its validity, our movement of movements must remain steadfast: the ERA is law. The People have spoken and we have the support of the legal community.
